Introduction

Welcome to the Ductmate website terms and conditions for use. Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Statement regarding personal information provided by you.

Before placing an order, if you have any queries relating to these terms and conditions, please email sales@ductmate.co.uk.

We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.

How to order / Browsing the store

Simply select an item from anywhere on this site, choose your preferred product and size option where applicable, then add to your shopping basket. You can keep an eye on the total number of items in your shopping basket, and how much you have spent, by checking the shopping basket, which is constantly on your screen.

When you have finished adding items to your basket, you will be led to the review order page where you can delete items if you've changed your mind or amend the quantities. This is where you should ensure that any FREE product offers that are running are also added into your Basket and are showing a discount amount as applicable.

You will then enter the checkout area where you supply your credit or debit card details.

If you have a Credit Account you will provide your Account Details.

Changing your Order

Unfortunately at this time it is not possible to make changes to orders online after they have been submitted.

If you want to change your mind please telephone our Sales Office on 01382 622 111.

If however your order has entered our despatching process we will not be able to make any changes. In these circumstances replacements will be sent to you following the procedures outlined in Claims & Acceptance below.

Delivery

Delivery can only be made to mainland UK addresses. Unfortunately at this time we cannot take online orders for delivery to International addresses. We reserve the right to change the areas to which we deliver without notice. Please contact our Sales Office on 01382 622 111 or email sales@ductmate.co.uk for overseas orders.

We aim to despatch orders received up to 12 Noon that same day for next working day delivery. PM orders will generally have a two working day delivery period. If a Royal Mail Parcel Service option is chosen then this is not a next day service.

Working days are defined as Monday to Friday inclusive and exclude Saturday, Sunday and all bank holidays. This timeframe is not guaranteed.

Warranty

Under this Warranty goods will be provided to replace any goods proven to be defective when applied in accordance with Ductmate's written instructions in applications recommended by Ductmate as suitable for the product. But all express or implied warranties or conditions, statutory or otherwise as to quality or fitness for a particular purpose of, the goods are hereby expressely excluded. It is an express condition, subject to which the goods are sold that Ductmate's liablility is limited to the above or to the net sales prices of the products.

Claims & Acceptance

To qualify for replacement, details of the goods alleged to be defective and subject to claim under the warranty must be notified in writing to Ductmate within one week of delivery. Such goods returned by you without prior agreement by Ductmate shall not be accepted by Ductmate. Ductmate's obligation to replace such goods is conditional on all instructions from Ductmate concerning storage, application, and use having been observed and you acknowledge herewith that you have duly received from Ductmate such instructions.

Consumer Protection (Distance Selling) Regulations 2000 (SI689/2005)

Notwithstanding the above section the DSR's give you a right to a cancellation period and refund of money.

The time limit for cancellation is at the end of seven working days after the day on which you received the goods. Notice of cancellation can also be made after you have placed the order but have not yet received the goods. The notice of cancellation must be in writing by letter, fax, or email addressed to Ductmate (EUROPE) Limited, Arrol Road, Wester Gourdie Industrial Estate, Dundee. DD2 4TH. A telephone call itself is not acceptable.

Following on the notice of cancellation you will be responsible for paying for the carriage costs for the return of the goods.

Once the goods have been returned to Ductmate a full refund will be made by either crediting back the amount on your credit card or if you are a Credit Account customer by the issue of a Credit Note.

Product Information

We have made every effort to display as accurately as possible the specification of our products that appear on the website.

All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published including prices and promotions.

Prices may be subject to change without notice. Prices are exclusive of VAT.

Indemnity

You shall comply with all instructions of Ductmate (as outlined on our website at www.ductmate.co.uk) in relation to the fitting, installation and use of the goods and notwithstanding such compliance, you shall keep Ductmate fully indemnified against all costs, claims, demands, expenses, and liability of whatsoever nature (other than in respect of death or personal injury arising from the negligence of Ductmate or its servants or agents) including claims for damage to property and consequential loss (including loss of profit) which may be made against Ductmate or which Ductmate may sustain, pay, or incur arising out of or in connection with the fitting, installation, or use of the goods.

Right to withdraw Goods

We reserve the right to withdraw any goods from the website at any time.

Purchase of Products

When you submit an order on our website we shall email you an acknowledgement of your order. Our acceptance of an order does not take place until the goods are despatched, at which point the purchase contract will be made.

We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following :

  • The product ordered being unavailable from stock.

  • Our inability to obtain authorisation of payment.

  • The identification of an error within the product information, including price or promotion.

  • If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time.

Risk & Ownership

( i ) Inrespect of all credit account customers the risk in the goods shall pass to that customer at the point of delivery.

( ii ) The ownership of the goods shall only pass to that customer at the date of the full payment of the purchase money and until such payment that customer shall hold the goods on behalf of Ductmate. If that customer sells the goods the sale shall be made by the customer as trustee for Ductmate and the proceeds of the sale shall be identified and kept separate as trust monies and held upon trust for Ductmate until all monies due to Ductmate by that customer have been paid in full. That customer shall not hold itself out as being the agent of Ductmate in respect of any contract of sale and no liability of any sort shall attach to Ductmate in respect of such sale.

( iii ) Should that customer become insolvent in any way, Ductmate shall be entitled to recover and re-sell the products, the ownership in which remains vested in it and Ductmate may enter at all reasonable times into the customers premises for that purpose.

The laws of Scotland shall govern the contract between us and any dispute between us will be resolved exclusively in the courts of Scotland. Your statutory rights are not affected.

We will take all reasonable care, in so far as it is within our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Payment

We can accept Visa Credit or Debit Cards, Mastercard, Electron, Maestro, Solo, and Switch Cards only.

We do not accept any cards where the address registered with the card issuer for the statement is outside the UK.

Your credit / debit card will be charged when you submit your order on the website .

If you have a Credit Account with Ductmate, unless expressely agreed in writing between Ductmate and yourself that it is otherwise, payment will be the last day of the month following the month in which the goods were despatched to you.

Credit card validation

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason authorise payment then you will be advised on-line after you have submitted the order and you will be returned to your shopping basket.

Health & Safety

You acknowledge that you have received from Ductmate (via our website at www.ductmate.co.uk) technical literature relating to the goods which may contain information on Health & Safety hazards and operating instructions in relation to the goods you are purchasing from Ductmates on-line website.

Force Majeure

Ductmate shall not be liable for any failure to perform its obligations hereunder in whole or in part if such failure is due to an Act of God, war, government regulations, strike, labour dispute, civil commotion, scarcity of raw materials, illness, flood, fire, tempest, or any other cause beyond the reasonable control of Ductmate.

General

All rights, including copyright, in this website are owned by or licensed to Ductmate. Any use of the site or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Ductmate.

We have taken every care in the preparation of the content of this website. To the extent permitted by applicable law, and save as otherwise specified by us, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website.

These exclusions of liability shall not apply to any damages arising from death or personal injury caused by our negligence.

These disclaimers and exclusions shall be governed by and construed in accordance with Scottish Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Security and Privacy

We offer fully secure online transactions, so you can shop whenever you want from home or work. This website is designed to work with Internet Explorer 5.5 and upwards and Netscape Navigator 6.0 which support SSL (Secure Sockets Layer).

When a purchase is made on our site, in addition to the above, we also ask for payment method details however we do not store credit or debit card details. We may obtain information about your usage of our Web site to help us develop and improve it further.

What the data will be used for?

Your data will enable us and our processors to fulfill your order and to notify you about important functionality changes.

If you opt in to receive information from us, the personal information given to us will be used to assist us in providing you with marketing material, including information about special offers, in store events and promotions. Do you provide my details to any other companies?

No.
